Refund Policy

Scope
This Refund Policy explains how fees and charges are handled for legal services provided by Visa Plan Migration Lawyers. It should be read together with the costs agreement and costs disclosure you receive at the start of your matter, which set out the specific terms that apply to you. Where this policy and your costs agreement differ, the costs agreement prevails.
Professional fees
Our professional fees are charged in accordance with your costs agreement under the Legal Profession Uniform Law. Fees are earned as work is performed. Where you have paid in advance and work has not yet been performed, any unearned amount is refundable. Fees for work already completed are not refundable.
Disbursements and government charges
Disbursements are amounts we pay to third parties on your behalf, such as Department of Home Affairs Visa Application Charges, skills assessment fees, and translation or medical costs. These are set by the relevant authority, not by us.
Government charges and third-party fees are subject to the refund rules of the body that imposes them. Many government charges, including most Visa Application Charges, are non-refundable once an application is lodged, regardless of the outcome. We cannot refund amounts that have been paid to and retained by a third party.
Trust money
Money you pay in advance for fees and disbursements is held and handled in accordance with the trust money requirements of the Legal Profession Uniform Law. Funds held in trust that have not been applied to costs incurred remain your money and are refundable to you.
Requesting a refund
If you believe a refund is due, contact us using the details below. We will review the work performed and amounts paid against your costs agreement and account to you for any refundable balance.
Fee disputes
If you have a concern about your legal costs, please raise it with us first so we can try to resolve it. You may also have the right to have costs assessed, or to make a complaint to the Victorian Legal Services Board and Commissioner (lsbc.vic.gov.au). Liability is limited by a scheme approved under Professional Standards Legislation.
