The request process

Endorsement comes before the request: the Media Federation of Australia and Advertising Council Australia must endorse the agency, and labour market testing evidence is lodged with the agreement request itself. The Department's template terms then apply without negotiation.

What the Advertising Industry Labour Agreement provides

The Advertising Industry Labour Agreement covers five occupations as Home Affairs lists them: Advertising Specialist (ANZSCO 225111), Graphic Designer (ANZSCO 232411), Copywriter (ANZSCO 212411), Multimedia Designer (ANZSCO 232413) and Web Developer (ANZSCO 261212). Workers are sponsored on the Skills in Demand visa (subclass 482), with the Employer Nomination Scheme visa (subclass 186) available after a three year transitional period.

The agreement carries its own salary floor rather than a concession: the worker must be employed full time and paid guaranteed annual earnings of at least AUD85,000, at market salary rates for the position. English is the Core Skills stream standard of the subclass 482 visa, and there is no age limit for the subclass 482, while subclass 186 applicants must be no more than 45 at the time of application. Nominees need at least three years of relevant work experience for a subclass 482 nomination and six years for a subclass 186 nomination.

Access depends on endorsement by the Media Federation of Australia and Advertising Council Australia before the agreement is requested, and labour market testing evidence must accompany the request. Home Affairs states the terms and conditions are set and non-negotiable.
