Investment Visa Extension
The subclass 188C extension stream allows existing Significant Investor stream holders who have not yet met the residency or investment requirements for the permanent subclass 888C visa to extend their provisional residence by four years. State and territory governments continue to accept extension nominations from existing 188C holders.
What the extension stream covers
The extension stream grants a further four years of provisional residence to subclass 188C holders who have maintained their complying investment but have not yet accumulated the required number of days in Australia to satisfy the subclass 888C residency requirement. It differs from the Business Innovation extension, which is two years.
State and territory governments assess extension nominations against the compliance record of the original 188C holder, including whether the AUD 5 million investment has been maintained in the required complying investment structure and whether the holder has settled in the nominating state as required.
The extension is available only to holders of the subclass 188C Significant Investor stream. It is not available to holders of the subclass 188B Investor stream, who must apply for the subclass 888B permanent visa directly on the basis of their original provisional visa period.
Eligibility requirements
Current subclass 188C holder
The applicant must currently hold a subclass 188C Significant Investor provisional visa. The extension is specific to this stream and is not available to other 188 stream holders.
Maintained complying investment
The AUD 5 million complying investment must have been maintained throughout the period of the original 188C visa in the required allocation structure. Evidence of ongoing investment compliance is required.
State or territory support
The nominating state or territory must support the extension application. States assess whether the holder has complied with original nomination conditions, including settlement requirements and material economic benefit criteria.
Residency shortfall
The extension is designed for holders who have not yet accumulated the days in Australia required for the subclass 888C. The residency calculation is based on a formula of 40 days per complete year of the 188C visa period.
