482 SID Nomination
The nomination is the employer's application to the Department of Home Affairs to fill a specific skilled position with an overseas worker under the Skills in Demand visa (subclass 482). It is the first stage of the two-stage employer sponsored visa process. A refused or withdrawn nomination prevents the visa application from proceeding.
What the nomination must establish
The employer must hold Standard Business Sponsorship approval before lodging a nomination. The nomination must establish that the position is genuine and ongoing, the occupation is eligible under the stream being applied under, and the nominated salary meets or exceeds both the applicable income threshold and the Annual Market Salary Rate.
Labour market testing is required for both the Core Skills stream and the Specialist Skills stream. Advertisements must have been active for at least 28 days and placed within four months before the nomination is lodged.
An approved nomination is valid for six months. The visa application must be lodged within that period. A refused nomination may be reviewed by the Administrative Review Tribunal within the applicable time limit.
Genuine position requirement
The nominated position must be genuine and ongoing. The Department assesses whether the role reflects a real employment need of the business, not a contrived position created to facilitate the visa.
Salary compliance
The salary must meet both the applicable income threshold (CSIT or SSIT) and the Annual Market Salary Rate for the occupation and location. Both requirements must be satisfied independently.
Skilling Australians Fund levy
Payable at nomination lodgement. For businesses with turnover below $10 million: $1,800 per year of the visa period. For businesses at or above $10 million: $3,000 per year. Non-refundable.
Labour market testing
Required for Core Skills and Specialist Skills streams. Advertisements must be active for at least 28 days and lodged within four months of the nomination. Evidence of the recruitment process must be retained.
