482 TSS 비자 신청을 위한 첫 단계로, 고용주는 Standard Business Sponsorship (SBS) 승인을 받아야 합니다. 신청 시, 고용주는 호주에서 합법적으로 사업을 운영하고 있음 소명해야 하며, 적극적으로 운영을 보여줘야 합니다. 호주가 아닌 다른 국가에서 사업을 운영하는 경우, 호주 사업 설립을 지원하거나 계약상 의무를 이행하는 조건으로 승인이 될수 있습니다.

482 TSS 비자 스폰서쉽이 승인될 수 있는 사업자의 형태는 아래와 같습니다.

  • Sole traders (개인사업자)
  • Partners in a partnerships (파트너쉽)
  • Trustees (신탁);
  • Companies, both proprietary and public (주식회사)
  • Government departments and statutory authorities (정부기관)
  • Non-profit organisations (비영리단체)
  • Educational institutions (교육기관)

 

합법적 사업 운영

 “합법적으로 설립되고 운영이” 되는 사업체임을 증명하기 위해서는, 사업 관할 구역 내에서 적용되는 모든 등록 요건을 충족해야 합니다. 여기에는 호주 국내의 법 뿐만 아니라 그 밖에서 적용되었던 법도 충족해야 합니다.

 호주의 기업의 경우, 이민성에서 사업체의 유형에 따라 요구하는 자료를 아래에 정리했습니다.

적극적 운영

적극적으로 운영이 되는 사업체임을 증명하려면, 해당업체의 영업 기록을 유지하여 이를 증거로 제출해야 합니다. 이 기준과 관련하여 이민성이 수용하는 증거 유형은 광범위합니다.

대부분의 허용 가능한 형태의 증거는 세무자료, 상업 계약서, 사업 계획서 및 임대계약서 등이 있습니다.

 

SBS 승인 기간

SBS의 승인을 받으면, 유효 기간은 일반적으로 5년입니다. 그 이후, 다시 재신청을 하여 5년을 추가적으로 발급받을 수 있습니다.

 

공인 스폰서

기업은 스폰서 승인 신청 또는 갱신 신청의 일환으로 ‘Accredited Sponsor’를 신청할 수 있습니다. ‘Accredited Sponsor’ 는 모든 임명 및 비자 신청이 우선적으로 처리 되어질 수 있도록 합니다. 모든 고용주가 Accredited Sponsor의 자격을 얻을 수 있는 것은 아니기에, 적격성을 확인하고 싶으시면 여기로 문의주시길 바랍니다.

 

후원자의 의무사항

승인된 스폰서는 아래에 명시되어있다 시피, 다양한 조건과 의무를 따릅니다. 이러한 조건을 준수하지 않을 경우 후원 자격이 취소되거나 중대한 민사 처벌 또는 행정 제재를 받을 수 있습니다.

  • cooperate with Inspectors who are appointed under section 140V, and exercising powers under the Migration Act;
  • ensure equivalent terms and conditions of employment of a sponsored person and those of an equivalent Australian worker;
  • pay travel costs to enable sponsored persons to leave Australia and keep records of any request to pay travel costs, as well as evidence of compliance therewith;
  • Reimburse the Commonwealth to locate and remove an unlawful non-citizen for whom the employer was a sponsor;
  • provide records and information in relation to reimbursement of travel costs to the Minister in on request and maintain said records for 2 years after sponsorship approval lapses;
  • provide information to the Department when certain events occur, such as termination or variation of a sponsored person’s employment;
  • ensure that the primary sponsored person works in the nominated occupation only;
  • not take actions that would result in another person paying for certain costs, including migration agent or solicitor assistance; and
  • not to act in a discriminatory manner in relation to one’s recruitment practices.

 

SBS 거절  – AAT

SBS에서 귀하의 기업을 거절을 했을 시, 재심기관(AAT)에 재심을 청구할 수 있습니다. 일반적으로, 해외에만 주소지를 두고 있는 사업체는 재심을 청구할 권리가 주어지지 않습니다.
