Subclass 864 Direct Pathway

Subclass 884/ 864 Transition Pathway

 

Subclass 864 visa allows Australian citizens, permanent residents and eligible New Zealand citizens to sponsor their retirement-aged parents for permanent residency. Subclass 864 visa enjoys much faster processing time when compared to Subclass 804 Aged Parent visa, but at a significantly higher cost. As of 30 January 2022, the fees are structured in the following terms:

  • First Instalment of the 864 Visa Application Charge, payable upon lodgement of the visa application.
    • Primary applicant: $4,225
    • Additional adult applicant charge: $2,110
  • Assurance of support, 10 year bond payable between lodgement and decision.
    • Single adult applicant: $10,000
    • Two adult applicants: $14,000
  • Second Instalment of the 864 Visa Application Charge, payable immediately before the visa grant.
    • $43,600 per applicant

The total cost for two (2) parents is $93,535 for the visa application charge plus the 10 year assurance of support bond of $14,000. The hefty second instalment is not payable should the visa application be unsuccessful.

It is possible to divide the second instalment by applying for a temporary parent visa (Subclass 884) first and later transitioning to Subclass 864 within two (2) years of the Subclass 884 visa grant. In this instance, the chronology of costs would resemble the below:

  • First Instalment of the 884 Visa Application Charge, payable upon lodgement of the visa application.
    • Primary applicant: $4,225
    • Additional adult applicant charge: $2,110
  • Second Instalment of the 884 Visa Application Charge, payable immediately before the visa grant.
    • $29,130 per applicant
  • First Instalment of the 864 Visa Application Charge, payable upon lodgement of the visa application.
    • Primary applicant: $370
    • Additional adult applicant charge: $190
  • Assurance of support, 10 year bond payable between lodgement and decision.
    • Single adult applicant: $10,000
    • Two adult applicants: $14,000
  • Second Instalment of the 864 Visa Application Charge, payable immediately before the visa grant.
    • $19,420 per applicant

In this transition pathway, the total cost for two (2) parents is $103,995 + a 10-year bond of $14,000, spread out over approximately 8 years.

Applicants must apply either Contributory Aged Parent visa from within Australia and be in Australia to be granted the visas. Whilst waiting for the outcome, the applicants will receive Bridging visas, permitting them to remain in Australia for the several years it will likely take for their applications to be determined by the Department.

 

Criteria for Grant

  • The applicants must be sponsored by a child who is a settled Australian citizen or permanent resident.
  • They must be above the retirement age that is 67 (as at 1 February 2022).
  • They must satisfy the Balance of Family test.
  • They must be in Australia at the time of visa application and decision.
  • They must not have any other pending parent visa application.

 

Balance of Family Test

Only living children are counted in this test. If the location of a child is unknown, they are assumed to be in their last known location. The test can be summarised in the following terms:

Are at least half of the applicant’s children eligible children living in Australia?

Or

Are there more eligible children living in Australia than in any other single country?

Common scenarios in which the test is passed include where:

  • 1 eligible child resides in Australia with 1 other child in another country;
  • 2 eligible children reside in Australia, and 1 other child in country A, 1 other child in country B;
  • 3 eligible children reside in Australia, 2 other children in country A, and 2 other children in country B

The first test is satisfied in the first two examples. In the third example, more children are in Australia than in any other country, thus satisfying the second test.

There are no conditions associated with this Subclass.

 

Contributory Aged Parent Visa Application Fees

Subclass 864 visa is payable in the following terms:

  • Base application charge for the primary applicant: $4,225
  • Base application charge for an additional secondary applicant who is at least 18 years old: $2,110
  • Base application charge for an additional secondary applicant who is younger than 18 years old: $1,060
  • 10 Year Assurance of Support Bond for the single applicant: $10,000
  • 10 Year Assurance of Support Bond for both parents: $14,000
  • Second application charge: $43,600 per applicant

Transition pathway of Subclass 884 and 864 visas attracts the charges in the below chronology:

  • 884 visa application fee for the primary applicant: $2,850
  • 884 visa application fee for an additional secondary applicant who is at least 18 years old: $1,425
  • 884 visa application fee for an additional secondary applicant who is younger than 18 years old: $715
  • 884 visa application fee prior to the visa grant: $29,130 per applicant
  • 864 visa application fee for the primary applicant: $370
  • 864 visa application fee for an additional secondary applicant who is at least 18 years old: $190
  • 864 visa application fee for an additional secondary applicant who is younger than 18 years old: $90
  • 10 Year Bond for the single applicant: $10,000
  • 10 Year Bond for both parents: $14,000
  • 864 visa application fee prior to the visa grant: $19,420 per applicant

The total cost of the transition pathway is not cheaper than the direct Subclass 864 visa application. The advantage of the transition only allows the cost to be staggered over longer time.
