Subclass 864 Direct Pathway
Subclass 884/ 864 Transition Pathway
Subclass 864 visa allows Australian citizens, permanent residents and eligible New Zealand citizens to sponsor their retirement-aged parents for permanent residency. Subclass 864 visa enjoys much faster processing time when compared to Subclass 804 Aged Parent visa, but at a significantly higher cost. As of 11 July 2023, the fees are structured in the following terms:
864 Visa Application Fee
Base application charge: $4,765
- Additional applicant charge for an applicant who is at least 18: $2,380
- Additional applicant charge for an applicant who is less than 18: $1,195
Assurance of support, 10 year bond payable between lodgement and decision.
- Single adult applicant: $10,000
- Two adult applicants: $14,000
Second instalment: $43,600 per applicant
It is possible to divide the second instalment by applying for a temporary parent visa (Subclass 884) first and later transitioning to Subclass 864 within two (2) years of the Subclass 884 visa grant. In this instance, the chronology of costs would resemble the below:
884 Visa Application Fee
Base application charge: $4,765
- Additional applicant charge for an applicant who is at least 18: $2,380
- Additional applicant charge for an applicant who is less than 18: $1,195
Second instalment: $29,130 per applicant
If you are a holder of a Subclass 884 visa when lodging a Subclass 864 application
Base application charge: $420
- Additional applicant charge for an applicant who is at least 18: $215
- Additional applicant charge for an applicant who is less than 18: $105
Assurance of support, 10 year bond payable between lodgement and decision.
- Single adult applicant: $10,000
- Two adult applicants: $14,000
Second Instalment: $19,420 per applicant
Applicants must apply either Contributory Aged Parent visa from within Australia and be in Australia to be granted the visas. Whilst waiting for the outcome, the applicants will receive Bridging visas, permitting them to remain in Australia for the several years it will likely take for their applications to be determined by the Department.
Criteria for Grant
- The applicants must be sponsored by a child who is a settled Australian citizen or permanent resident.
- They must be above the retirement age that is 67 (as at 1 February 2022).
- They must satisfy the Balance of Family test.
- They must be in Australia at the time of visa application and decision.
- They must not have any other pending parent visa application.
Relevant Public Interest Criteria
4001, 4002, 4003, 4004, 4005, 4009, 4010, 4020, 4021 and 4019 (if applicable).
